CLP Regulation Update
The EU has updated the CLP regulation concerning the classification, labeling, and packaging of chemicals. This change clarifies rules related to chemical classification and labeling, as well as the information obligations for chemicals sold online. EU Regulation (EU) 2024/2865 amends the existing CLP regulation (EC No. 1272/2008), which regulates the classification, labeling, and packaging of chemicals.
This update affects nearly all businesses dealing with chemicals, from large manufacturers to small online retailers. The changes aim to enhance human health and environmental protection.
Key Changes:
- Warning Label Requirements: Label readability is improved by defining the minimum font size, line spacing, and font type. Additionally, the text must be black with a white background.
- Fold-out Labels: The use of fold-out labels is expanded, provided their readability and content (front, inside, and back pages) comply with the regulations.
- Chemical Labeling Requirements for Online Sales: Stricter requirements apply to the information presented in e-commerce and advertisements.
- Classification of Complex Substances: Clearer rules for substances containing multiple ingredients and mixtures that include such substances.
- Refill Stations: New regulations are introduced for selling chemicals, such as detergents, through refill stations.
- Service Station Pump Labeling: New labeling requirements for service station pumps for gasoline, diesel, and windshield washer fluid.
- Warning Labels for Consumer Canisters: Consumers filling their own fuel canisters must be given a warning label by the service station.
- Distributor Reporting Obligation: Distributors must report information about hazardous mixtures to poison centers when distributing them under different trade names or in different EU member states.
Schedule
The amended regulation came into effect on December 10, 2024. However, a transition period has been granted for the implementation of new requirements, which will be enforced in phases on either July 1, 2026, or January 1, 2027, depending on the requirement.
During the transition period, substances and mixtures packaged and labeled before the new rules take effect can still be marketed for two years, allowing businesses to sell their existing stock.
Additionally, the European Commission has introduced new hazard classes to the CLP regulation, which will apply to substances from May 1, 2025, and to mixtures from May 1, 2026.
